“Pay-As-You-Go” Charging Terms and Conditions

This service to use electric vehicle charge points on a Pay-As-You-Go (“PAYG” ) basis ( “PAYG Service” ) is operated by Bluepointlondon Limited (company number 08803842) of 5 Cavendish Square, London W1G 0PG through our mobile website at sourcelondon.net ( “Website” ). Our VAT number is 7167428239. “Source London” is a trade mark and trading name of Bluepointlondon Limited.
PLEASE READ THESE TERMS AND CONDITIONS ( “TERMS” ) CAREFULLY. IF YOU DO NOT AGREE TO THESE TERMS, PLEASE REFRAIN FROM ACCESSING OR USING OUR WEBSITE OR ANY FUNCTIONALITY THEREOF. YOU MUST FOLLOW CERTAIN RULES WHEN USING THE PAYG SERVICE, AS REFERRED TO BELOW.
By requesting to use the PAYG Service, you confirm to us that you are at least 18 years of age.
You can save or print out a copy of these Terms when proposed on our Website throughout the contractual process.Is my vehicle compatible? This PAYG Service is for “Compatible Vehicles” only (i.e. any electric vehicle licensed for use on the road by the Driver and Vehicle Licensing Agency that was manufactured after 2016). How much does it cost? You will be charged “Session Fees” based on how long you use the charge point (from when we say that “You can now plug your car!” on the Website and you connect your car to the charge point to when you end the charging session by unplugging your vehicle from the charge point, calculated at the rates set out below at “Our Rates” .
Minimum charging periods / overnight cap / Central London surcharge. For 7.4kW and 22kW charge points, the minimum charging period is twenty (20) minutes, and for 50kW charge points, the minimum charging period is ten (10) minutes, meaning. As explained in “Our Rates” below, for 7.4kW charge point sessions between 8pm-7am, an overnight cap will apply; and for charge points in certain boroughs, a Central London surcharge will apply.
Payment. We don’t hold your credit or debit card details. You will be directed to an online payment processing service provider for payment. Soon after you unplug your vehicle, we will confirm through the Website how long you used the charge point, and you will be charged based on Our Rates. An invoice will be sent to the email address you gave us. t. We will debit the invoice amount from your credit or debit card.
Rules. You must be plugged in when using the space. If the charge point is in a car park, you may have to pay parking fees separately to the fees you pay us to charge . Do not park or try to use a charge point in a space with a Red light (charge point not working) or Blue light (charge point reserved). Please pay attention and follow the signs. Some charge points are subject to usage time limits and restrictions on returning to a particular space within a prescribed time. Park correctly within your space. You will be liable to parking enforcement action if you do not follow parking rules that apply to the space from which you use the charge point.
Your right to cancel . Since PAYG service is a straightforward service allowing you to use it immediately, you will be requested to give your consent to request the PAYG service immediately. Consequently, you will not have a right to cancel the contract.
Your responsibilities. You are responsible for any damage your misuse or lack of care causes to a charge point and must tell of any such damage immediately by contacting our Customer Relations Centre. Use the charge point safely and be aware of tripping hazards. Follow any directions our Customer Relations Centre may give you on a phone call, for safety purposes. You must behave respectfully towards our staff.
Our responsibilities. We use reasonable care and skill in providing the PAYG Service. We are responsible to you for loss or damage you suffer that is a foreseeable result of our breaking this contract or failing to use reasonable care and skill. Loss or damage is foreseeable if either it is obvious that it will happen or if, at the time the contract was made, both we and you knew it might happen. Where we are responsible to you for loss or damage under these Terms (which need to be read as a whole) , our total liability to you is limited to £100,000.
Where we are not responsible. We are not responsible for (a) any loss or damage (including to your vehicle or your personal property) that is either not foreseeable, or (even if foreseeable) is not caused by our breach of this contract or failure to use reasonable care and skill; nor for (b) any failure to perform, or delay in performance of, any of our obligations that is caused by your failure to comply with the Rules or Your responsibilities that we refer to above in these Terms. We will also not be liable for any failure to perform or delay in performing our obligations in any circumstances caused by events outside of our control, as long as we take reasonable steps to prevent or minimise such circumstances. These types of events could include (amongst others) terrorist attacks, natural disasters, failures of systems due to computer viruses that do not result from our negligence, and failure or disruption to GPS satellites or communication networks. If you use the PAYG Service for any commercial or professional purposes, we will have no liability to you for any loss of profit, loss of business, depletion of goodwill, loss of business opportunity or for any indirect or consequential losses.
Rapid Charge Point disclaimer. Although we provide Rapid Charge Points (charge points that can deliver 22 Kw or more) for your convenience, there is some evidence that use of a Rapid Charge Point can damage your vehicle and its battery. This is part of the inherent risk of using a Rapid Charge Point and if you use a Rapid Charge Point, you accept these inherent risks.
Losses that we do not exclude or limit. Nothing in this contract shall limit or exclude our liability to you for: (a) death or personal injury caused by our negligence; (b) fraud; or (c) any other liability which cannot be limited or excluded by applicable law. This shall take precedence over any other exclusions or limitations of our liability in these Terms.
General. Only you and we (and no other person) have rights under these Terms. You may not transfer any of your rights or obligations under these Terms. We may transfer our rights and obligations under these Terms to another organisation. We will let you know if we plan to do this. If we do not insist immediately that you do anything you are required to do under these Terms, or if we delay in taking steps against you in respect of you breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. Each of the paragraphs of these Terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will not be affected. You should print a copy of these Terms or save them to your computer for future reference. These Terms, and any contract between us, are only in the English language. These Terms are governed by English law. If you bring legal proceedings before a court in respect of the PAYG Service, you may only do so in the English courts, except if you live in Scotland where you may bring legal proceedings either the Scottish or the English courts; or if you live in Northern Ireland, in which case you may bring proceedings in either Northern Irish or English courts.

If you are not happy with how the Customer Relations Centre has handled any complaint, or how your complaint was resolved, you can ask us to escalate your complaint within our organisation. You can also commence an alternative dispute resolution process (where an independent body considers the facts of a dispute and seeks to resolve it, without you having to go to court). Disputes can also be submitted for online resolution to the European Commission Online Dispute Resolution platform ( http://ec.europa.eu/consumers/odr/ ) (though this may change depending on Brexit).
